1. PRIVACY

1.1 Protecting Your Privacy

An important part of our commitment to provide you with service excellence is respect for your privacy. We are committed to protecting your privacy and earning your trust, and understand that you may have concerns about how we use the Collected Data. For further details, please refer to sections 1.2, 1.3 and 1.4 below. For the purpose of the Program, personal information includes your mobile phone number and all Collected Data collected by the application. This information will only be used by Driven Telematics, Inc. to fulfill the process directly linked to the Program services, described in the Terms and Conditions. DRIVEN will not otherwise use personal information, or disclose or transfer personal information to any third party except as required by law.

1.2 Information the Application Collects

The application records: -Vehicle location (GPS) -Accelerometer Data (Accelerations) Gyroscope Data (Rotational Movements) -Time -Application power on/off This information is transmitted wirelessly to DRIVEN. Other information is derived, as described in section 2.1 on the terms and conditions, by DRIVEN from this information. Collectively, all of the above types of information are referred to as "Collected Data".
This Collected Data is then sent from DRIVEN to us. It is important to understand that all of the information collected is based on the data collected on your smartphone for you. It is also important to note that the application collects and transmits Collected Data concerning you regardless of the vehicle that you are operating at the time. In other words, the Collected Data applies to any vehicle operated by you.

1.3 How Program Information is Used

The following data, derived as described in section 1.2 of the terms and conditions, will be used by us to calculate the driving score, based on your driving behavior which includes:

● Speed
● Distance Travelled
● Phone Motion while driving

As stated above in section 1.2 of the terms and conditions, it is important to understand that all of the information collected is only for the purpose of calculating your driving score.

1.4 How the Collected Data will not be Used

Collected Data during the program will be used to calculate your driving score and provide you with feedback on driving performance. We will disclose Collected Data only to participating third parties including insurance carriers and insurance agencies, in the attempt to provide you an auto insurance quotation.

1.5 License to Use

Provided that you comply with all of these Terms and Conditions & Privacy Policy, we grant you a revocable, limited and non-transferrable license to use the application on any smartphone that you own or control and as permitted by Usage Rules set forth in the Apple App Store Terms and Conditions or the Google Play Terms of Service, whichever is applicable.

1.6 Disclaimer of Warranty

This application is licensed "as-is", "with all faults" and "as available". You bear the risk of using it. We, on behalf of ourselves, the creator of the application, distributors of the application, network operators over whose network the application is distributed, and each of their respective affiliates and suppliers, give no express or implied warranties, guarantees, or conditions under or in relation to the application. This includes, but is not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the functionality or operation of the application will be uninterrupted or free from error, that any defects in the application will be corrected, or that the application or the server(s) that makes it available are free of viruses or other harmful conditions or components.

1.7 TCPA Disclaimer

By installing the DRIVEN application, I expressly consent to receive marketing calls and texts (including via automatic telephone dialing system or by artificial/pre-recorded message) and email from DRIVEN, it’s insurance carrier partners and insurance agency partner(s) at the telephone number above (even if my number is currently listed on any state, federal, local, or corporate Do Not Call list) including my wireless number if provided. Carrier message and data rates may apply. I understand that my consent is not required as a condition of purchasing any goods or services and that I may revoke my consent at any time. I also acknowledge that I have read and agree to the Terms & Conditions.
